a\u00f1os de prisi\u00f3n\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">El 30 de agosto de 1976, el conscripto Roberto Villafa\u00f1e fue asesinado de un tiro en la espalda cuando intentaba huir de un grupo de soldados que lo quer\u00edan secuestrar. Por este hecho fue condenado a 20 a\u00f1os de prisi\u00f3n el ex soldado Jos\u00e9 Rodr\u00edguez, quien efectu\u00f3 el disparo. En la causa fue aportada como prueba el sumario de prevenci\u00f3n que se le realiz\u00f3 a Rodr\u00edguez en donde se prueba que Villafa\u00f1e hab\u00eda sido objeto de seguimientos por formar parte del PRT- ERP, al que tambi\u00e9n pertenec\u00eda otro conscripto desaparecido, Alberto Agapito Ledo, y que su detenci\u00f3n fue ordenada por el jefe de la unidad militar en la que estaba asignado.<\/span><\/p><p><span style=\"font-weight: 400;\">Durante el juicio declararon 15 testigos.<\/span><\/p><p><span style=\"font-weight: 400;\">La Sala II de la C\u00e1mara Federal de Casaci\u00f3n Penal, integrada por los jueces Alejandro Slokar, Angela Ledesma y Pedro David, confirm\u00f3 la condena a veinte a\u00f1os de prisi\u00f3n impuesta al ex integrante del ej\u00e9rcito Jos\u00e9 Rodr\u00edguez por el asesinato del conscripto Roberto Nicol\u00e1s Villafa\u00f1e durante la dictadura c\u00edvico-militar.<\/span><\/p><p><span style=\"font-weight: 400;\">La v\u00edctima, un joven soldado de 18 a\u00f1os de edad, fue ejecutada a tiros por la espalda, cuando intentaba escapar de un operativo desplegado en La Rioja por personal del Ej\u00e9rcito y de la Polic\u00eda, en raz\u00f3n de una sospecha por presuntos v\u00ednculos con dos personas desaparecidas y el obispo Enrique Angelelli.<\/span><\/p><p><span style=\"font-weight: 400;\">La Casaci\u00f3n tuvo por probado que \u201cel ataque a la vida de Villafa\u00f1e ocurri\u00f3 en marco del plan generalizado y sistem\u00e1tico de represi\u00f3n contra seres humanos desplegado por el \u00faltimo gobierno de facto\u201d y que, por lo tanto, \u201cencuadra en la categor\u00eda de lesa humanidad que apareja las imprescriptibles e imperativas obligaciones de investigaci\u00f3n y
